Our Estimate will provide a full breakdown of all disbursements (payments to third parties) such as Stamp Duty; HM Land Registry fees and Searches.

All Property matters are overseen by David Billingham who has wide experience in dealing with both Residential and Commercial Property. We will also provide written advice on the steps which will need to be taken in the course of the Conveyancing matter.

Our Probate and Will Service

The Legal issues following a death can be quite complex, particularly where probate is required (an application for a right to deal with a deceased person's affairs by the Executors of the Will). If the Deceased did not leave a Will then it is necessary to determine who can seek a Grant of Letters of Administration.

This is also a distressing time for those concerned and we therefore combine our expert advice with a thoughtful and compassionate approach.

The Service we provide will be undertaken by David Billingham who has long and wide experience in dealing with Probate cases it include:

  • Identify the legally appointed Executors or Administrators and beneficiaries. Determining if all the Executors or potential Administrators wish to seek the Grant of Probate or Letters of Administration and, if necessary, preparing documents for the reservation of power or renunciation of the appointment.
  • Accurately identify the type of Probate application you will require
  • Determining the assets and liabilities of the Estate
  • With your assistance obtaining the relevant documents required to make the application for Probate
  • Complete the Probate application and the relevant Inheritance Tax forms
  • Prepare the Probate papers and Inheritance Tax forms for you to sign
  • Arrange for the payment of any inheritance tax
  • Make the application to the Probate Court on your behalf
  • Obtain the Probate or Letters of Administration and provide you with copies.
  • Collect the Estate assets and discharge Estate liabilities
  • With your Accountant (if appointed) ensure all income tax matters are settled with HMRC
  • Prepare Estate Accounts
  • Distribute the Estate in accordance with the Will and the Law.


The exact costs of dealing with the above will depend on the individual circumstances in each case it depends on the time spent by those dealing with the matter. We will provide with advice on costs in our initial letter once we have information from you in relation to the Estate. As guidance the hourly rate for David Billingham in Probate matters is £225 + VAT.

There will be a Probate Court fee to be paid in addition to our Professional fees and any other disbursements being payments to third parties.

It is the intention to apply for the Grant of Probate or Letters of Administration as quickly as possible subject to all information being available to complete the Probate application and Inheritance Tax Forms. We cannot advise on the time which would be taken either by the Inheritance Tax Office or the Probate Court in issuing the Grant. Those factors are outside our control.

Our Wills and Lasting Powers of Attorney Service

We are able to provide full advice in relation to the making of your Will and the issues you should consider.

Our normal charge for a single Will not involving the creation of a trust is £325 + VAT. If we were acting for you and your Husband/Wife or Partner the total charge will be £425 + VAT.

We can also advise on the making of a Lasting Power of Attorney to cover Property and Finance or the separate Heath and Welfare. If it was necessary to make an application to the Court of Protection we can prepare all the documents to support an application for the appointment of a Deputy.

Again, we would provide you with advice initially on the costs and the Court fees.
